These Terms of Service ("Terms") govern your use of the KinHound web app, mobile apps, and websites (the "Service"), operated by ASPL ("KinHound," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who can use KinHound
You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract. If you use KinHound on behalf of a family or organization, you represent that you are authorized to accept these Terms for it.
Your account
- You are responsible for the activity on your account and for keeping your login credentials secure.
- Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use of your account.
- You may sign in with email, or with Apple, Google, or Facebook. Your use of those providers is subject to their terms as well.
Invite-only family trees
KinHound is private and invite-only. A tree and its contents are visible only to the members invited to it. You are responsible for who you invite and for the information you choose to share within a tree.
Your content and family information
- You retain ownership of the content you add. You grant KinHound a limited license to host, store, process, and display that content solely to operate and improve the Service for you and the family members you share it with.
- A family tree contains information about other people. You agree to only add information you have a reasonable basis to share, to respect the consent controls in the app, and to honor requests from relatives to correct or remove their information.
- You are responsible for ensuring your content does not violate the law or the rights of others.
Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose;
- Harass, stalk, impersonate, or violate the privacy of any person, including using relative-discovery features to contact people without consent;
- Upload content that is illegal, infringing, defamatory, or that you do not have the right to share;
- Attempt to access accounts or trees you were not invited to, or probe, scan, or breach the Service's security;
- Scrape, reverse engineer, overload, or interfere with the Service or its infrastructure;
- Resell or commercially exploit the Service without our permission.
Third-party services and sources
KinHound integrates third-party services (such as authentication, image hosting, maps, and public genealogy sources). We are not responsible for the content, accuracy, or practices of those third parties, and your use of them may be subject to their own terms.
The Kin family of apps
KinHound is a separate product from KinCoffer; each has its own account and terms. These Terms cover KinHound only.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination will survive.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that genealogy suggestions or third-party data are accurate or complete, or that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, KinHound and ASPL will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior twelve months or USD $50.
Changes to the Service and Terms
We may modify the Service or these Terms. When we make material changes to these Terms we will update the "Last updated" date and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless your local law provides otherwise.
